Please review this User Terms of Service Agreement (referred to as the "Agreement") carefully before using any product or service provided by CallFusion Corp ("CallFusion", "Company", or the "Service Provider") through the ProRates platform ("ProRates" or "Platform").
THIS DOCUMENT STATES THE TERMS AND CONDITIONS UNDER WHICH CALLFUSION CORP OFFERS YOU ACCESS TO THE PRORATES MORTGAGE RATE COMPARISON PLATFORM AND RELATED SERVICES. THESE TERMS CONSTITUTE A BINDING CONTRACTUAL AGREEMENT BETWEEN YOU AND CALLFUSION CORP.
By accessing and using the ProRates website and mortgage comparison services provided by CallFusion Corp, you, the user (referred to as "Client", "User", or "You"), acknowledge and agree to be bound by this Agreement. This Agreement applies to all products and services offered through ProRates, including but not limited to mortgage rate comparisons, calculators, educational content, and lead generation services.

By accessing or using the ProRates Service, you agree to be bound by this Agreement. If you do not agree to these terms, you must not use the Service.
ProRates provides a mortgage rate comparison platform that displays current mortgage rates from various Canadian lenders. The Service includes:
ProRates is operated by CallFusion Corp and serves as an intermediary platform. We do not directly provide mortgage services or act as a lender.
While ProRates strives to provide accurate and up-to-date mortgage rate information, we cannot guarantee the accuracy, completeness, or timeliness of all rate data. Mortgage rates are subject to change without notice and may vary based on individual circumstances, creditworthiness, and lender policies.
Users are encouraged to verify all rate information directly with lenders before making any financial decisions. ProRates is not responsible for any discrepancies between displayed rates and actual rates offered by lenders.
Users agree to use the ProRates Service in compliance with all applicable local, provincial, and federal laws and regulations, including but not limited to privacy laws, consumer protection laws, and the Personal Information Protection and Electronic Documents Act (PIPEDA).
Users agree to provide accurate and truthful information when using the Service, including when submitting quote requests or contacting mortgage professionals through the Platform.

Your privacy is important to us. The collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated by reference into this Agreement. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.
When you submit a quote request or contact information through the Platform, you consent to being contacted by mortgage professionals and lenders regarding your mortgage needs.
All content on the ProRates Platform, including but not limited to text, graphics, logos, images, software, and the overall design, is owned by CallFusion Corp or its licensors and is protected by copyright, trademark, and other intellectual property laws.
Users are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes only. Users may not reproduce, distribute, modify, or create derivative works from any content on the Platform without prior written permission.
ProRates displays mortgage products and rates from various third-party lenders. CallFusion Corp is not responsible for the accuracy of information provided by these lenders or for the products and services they offer. Any interactions or transactions between users and third-party lenders are solely between those parties.
ProRates may receive compensation from lenders for leads generated through the Platform. This compensation does not influence the rates displayed or the order in which lenders are presented.
The ProRates Service is provided "as is" and "as available" without any warranties of any kind, whether express or implied. CallFusion Corp disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
The information provided on ProRates is for informational purposes only and does not constitute financial advice. Users should consult with qualified financial advisors and mortgage professionals before making any mortgage-related decisions.
In no event shall CallFusion Corp, its employees, directors, officers, agents, shareholders, subsidiaries, or affiliates, under any circumstance, be liable for any indirect, incidental, special, consequential, exemplary, punitive, or aggravated damages arising out of or related to this Agreement or the use of the ProRates Service, including any loss of revenue, profits, data, or business opportunities. The aggregate liability of CallFusion Corp for all claims arising out of or relating to the use of or any inability to use the Service, whether in contract, tort, or otherwise, is limited to $100.
Users agree to indemnify and hold harmless CallFusion Corp and its affiliates from any claims, damages, liabilities, and expenses arising out of or related to the User's use of the Service or violation of this Agreement.
CallFusion Corp reserves the right to terminate or suspend access to the ProRates Service at any time, with or without cause, and with or without notice. Users may discontinue use of the Service at any time.
Upon termination, all rights and obligations under this Agreement shall cease, except for those provisions that by their nature should survive termination.
CallFusion Corp reserves the right to modify these Terms of Service at any time. Changes will become effective upon posting on the ProRates website. Continued use of the Service after any modifications indicates acceptance of the revised terms.
This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
